Do I Need a Permit to Build a Fence?

Short answer

Usually not — the model code (IRC R105.2) exempts fences up to 7 feet tall from building permits. Taller fences, retaining-wall fences, and masonry walls generally need one, and zoning height limits are often stricter than 7 feet.

Usually exempt (no building permit)

  • Fences up to 7 ft tall in most states (some jurisdictions use 6 ft)

Permit required

  • Fences over 7 ft — these are engineered structures under wind load
  • Masonry or concrete walls above exempt heights
  • Fences that also retain soil (treated as retaining walls)
  • Pool barriers — exempt from a separate permit in some places but must meet strict barrier code (height, gaps, self-latching gates) and are inspected with the pool permit

What trips people up

  • Zoning commonly limits front-yard fences to 3–4 ft and side/rear to 6 ft — lower than the building-code exemption
  • Corner lots have sight-triangle rules near intersections and driveways
  • Property-line disputes: a survey is cheaper than moving a fence
  • Some cities require a zoning or fence permit even when no building permit applies

How to apply

Where required, fence permits are among the simplest: a site plan with fence line, height, and materials. Many cities approve online the same week.

Check your jurisdiction: exemption thresholds are from the 2021 IRC (R105.2) as adopted by most states — your city or county may amend them. Find your local building department, adopted codes, and online permit portal on the BuildSpec permit pages.
