Determination of the Engineer that the Contractor’s chosen materials or procedures conform to the requirements of the plans and specifications with respect to providing an acceptable and safe project. These term s shall not be construed as a warranty by the Department that the Contractor’s methods will succeed or will be the most efficient or economical method of accomplishing the work, nor shall the terms be construed as a warranty that the actual materials used in construction will perform as represented in test results supplied to the Department by the Contractor.
