SECTION 167 — Water Quality Monitoring

167.1General Description

This Specification establishes the Con tractor’s respons ibility to meet the re quiremen ts of the current National Pollutant Discharge Elimination System (NPDES) Infrastructure Permit No. GAR100002 as it pertains to Part IV. Erosion, Sedimentation and Pollution Control Plan. In the case of differing requirements between this specification and the Permit, whichever is the more stringent requirement shall be adhered to. 167.1.01 Definitions Certified Personnel— certified personnel are defined as persons who have successfully completed the appropriate certification course approved by the Georgia Soil and Water Conservation Commission. For Department projects the certified person must also have successfully completed the Department’s Worksite Erosion Control Supervisor (WECS) certification course. Water Quality Sampling – as used within this specification, the term “sampling” shall be inclusive of the acts of detecting, noting, discerning, monitoring, etc. for the purpose of gauging compliance with the NPDES General Permit GAR100002. Qualifying Rainfall Sampling Event—as u sed within this specification, means that which is defined in the NPDES General Permit GAR100002, Part IV.D.6.d(3). 167.1.02 Related References

167.3Construction Requirements

167.3.01 Personnel Use GASWCC L evel IA cer tified and WECS certified p ersonn el to pe rform all monit oring , sampling , inspections, and rainfall data co llection . Use the Con tractor-designated WECS or select a pre qualified consult ant from the Qualified Consult ant List (QCL) to perform w ater quality monit oring, sampling, inspections, and r ainfall data co llection . A.General

Perform inspections, r ainfall d ata collection, testing of samples, and re porting the test results on the project according to the requirements in Part IV of the NPDES Infrastructure Permit and this Specification. Take samples m anually or use automatic samplers, acc ording to the GAR100002 Permit . Note that the GAR100002 P ermit requires the use of manual sampling or rising stage sampling for qualifying events that occur after the first instance of th e aut omatic sampler not being activated during a qualifying event. Analy ze all samples according to the Permit , r egardless of the m ethod used to collect the samples . If samples are analyzed in the field using portable tur bidimeters, the monit oring results shalls tate they are b eing us ed and a digital re adout of NTUs is wh at is pr ovided . Submit bench sheets, w ork sheets, etc., when using portable turbidimeters. There are no exc eptions to this requiremen t. Perf orm required inspections and submit all rep orts required by this Specification within the time frames specif ied. Failure to perform the inspections within the time specified will r esult in the cess ation of all construction activities wit h the exc eption of traffic c ontrol and e rosion con trol. Failure to submit the required reports within the times specified will r esult in no n -refundable deductions as specif ied in Subsection 161.5.01.B.

B.Water Quality Inspections

The Department will provide one copy of the required inspection forms for use and duplication. Inspection forms may change during the contract to reflect regulatory agency needs or the need of the Dep artment . Any cos ts as sociated wi th the change of inspection forms shall be considered incidenta l. Alternate formats of the provide d fo rms may be created, used and submitted by the Contractor provided the required content and/or data fields an d v erbatim certi fication statements from the Dep artment ’s current forms are incl uded. The Engineer shall inspect the installation and condition of each erosion control device required by the erosio n co ntrol plan within seven days after initial installation. This inspection is performed for each stage of construction when new devices are installed. The WECS shall ensure all installation deficiencies reported by the Eng ineer are corrected wi thin two business days. Ensure the inspections of the areas listed below are conducted by certified personnel and at the frequencies listed. Document all inspections on t he appropriate form provided by t he Dep artment. 1.Daily (when any work is occurring) : a.Petroleum product storage, usage and handling areas for spills or leaks from vehicles or equipment. b.All locations where vehicles enter/exit the site for evidence of off-site sediment tracking. 2.W eekly and af ter Rainfall Events: C ondu ct ins pectio ns on these areas every seven calen dar days an d within twenty-four h ours after the end of a rainfall event that is 0.5 in (13 mm ) or greater (unless such storm ends after 5:00 PM on any Friday or any non- working Saturday, non- working Sunday or any non- working Federal holiday in which case the inspection shall be completed by the end of the next business day and/or working day, whichever occurs first): a.Disturbed areas not permanently stabilized b.Material storage areas that are exposed to precipitation or stormwater and poses a risk t o d ischarging p ollutants c.Structural control measures, Best Management Practices (BMPs) to ensure they are operating correctly d.Water quality sampling locations and equipment e.Discharge locations or points, e.g., outfalls and drainage structures that are accessible to determine i f er osion control measures are effective in preventing significant impacts to receiving waters Continue these inspections until all temporary BMPs are remove d and a NOT is submitted and use the EC-1 Form. 3.Monthly: O nce per month, inspect all areas where final stabilization h as been completed. L ook for evidence of sediments o r pollu tants en tering the drainage system and or rec eiving waters. I nspect all permanent erosion control devices rem aining in p lace to verify the m aintenance status and that the dev ices are functioning properly . Inspect discharge locations or points, e.g. outfalls, drainage structures, that are accessible to determine if erosion control measures are effective in preventing significant impacts to receiving waters. Continue these inspections until t he Notice of Termination is subm itted and use the monthly inspection form.

C.Water Quality Sampling

When the sampling location is a receiving water, the upstream and downstream samples are taken for compariso n o f NTU values. When the sampling location is an out fall, a single sample is taken to be analyzed for its absolute NTU value. 163 163 163 163 163 163 163 163 163 163

D.Reports 1.Inspection Re ports: Summ arize the results of inspections noted above in writi ng on the a ppropriate Dail y, Weekly, M onthly, or EC-1 form prov ided by the De partment and i ncludes the followin g information : •Date(s) of inspection •Name of certified personnel performing inspection •Construction phase •Status of devices •Observations •Action taken in accordance with Part IV.D.4.a.(5) of the GAR100002 Permit •Signature of personnel performing the inspection •Any instanc e of non-compliance When the report does not identify any non- compliance instances, the inspection report shall contain a statement that the best management practices are in compliance with the Erosion, Sedimentation and Pollution Control Plan. (See the EC -1 form.) The reports shall be made and retained at the site or be readily available at a designated alternate location until the entire site or that portion of a construction project that has been phased has undergone final stabilization and a Notice of Termination is submitted to the Georgia Department of Natural Resources Environmental Protection Division (GAEPD). Such reports shall be readily available by the end of the second business day and/or working day and shall identify all incidents of best management practices that have not been properly installed and/or maintained as described in the plan. The inspection form certification sheet shall be signed by the project WECS and the inspector performing inspections on behalf of the WECS (if not the same person). Submit all inspection reports to the Engineer within twenty -four hours of the inspection. The Engineer will review the submitted reports to determine their accuracy. The Engineer will notify the certified personnel of any additional items that should be added to the inspection report. Complete any items listed in the inspection report requiring routine maintenance within seventy –two (72) hours of notification or immediately during perimeter BMP failure emergencies. Deficiencies that interfere with traffic flow, safety, or downstream turbidity shall have immediate reasonable steps taken to address the deficiencies. BMP(s) that has failed or is deficient beyond routine maintenance and has resulted in sediment deposition into waters of the State shall have immediate reasonable steps taken to address the condition, including but not limited to cleaning up any contaminated surfaces so the sediment material will not discharge in subsequent storm events. When the repair does not require a new or replacement BMP or significant repair, the BMP failure or deficiency must be corrected by the close of the next business day from the time of discovery. If the correction requires a new or replacement BMP or significant repair, the correction must be completed and operational within seven (7) days from the time of discovery. If seven (7) days is infeasible, the Contractor must document why the timeframe is infeasible and coordinate with the Engineer to schedule the correction as soon as feasible after the seven (7) day timeframe. The Department must be in agreement with the infeasibility assessment. Assume responsibility for all costs associated with additional sampling as specified in Part IV.D.6.d.3.(c) of the NPDES GAR100002 Permit if either of these conditions arise: •BMPs shown in the Plans are not properly installed and maintained, or •BMPs designed by the Contractor are not properly designed, installed and maintained. 164 164 164 164 164 164 164 164 164 164

2.Sampling Re ports a.All sampling shall be performed in accordance with the requirements of the GAR100002 Permit for the l ocations identified in the ESPCP approved by the Department. b.Report Re quirements I nclud e in al l reports, the followin g certification statement, signed by the WECS or consultant prov iding sa mpling o n the proj ect: “I certify under penalty of law th at this report and all attac hments were prepared under my direc t supervision in acc ordance with a system d esigned to assure th at certified pe rsonn el prope rly gather and evaluate the informati on subm itted. Based on my inquiry of the person or persons wh o manage the syst em, or t hose persons directly r esponsible for g athering the informati on, the informati on is, to the best of my knowledge and belief, t rue, accurate and c omplete. I am awar e that there are significant penalties for submitting false information , including the poss ibility of fin e and imprisonment for knowing violations .” When a r ainfall event re quires a sample to be taken, submit a re port of the sampling r esults to the Enginee r withi n seven working days of the d ate the sample was obtaine d. Includ e the followin g informati on in each report: 1)D ate and time of sampling 2)N ame of certified person(s) who performed the sampling and analyses. 3)D ate the analyses were performed 4)T ime the analyses were initiated 5)R ainfall amount on the sampling date (sampling date only) 6)R eferences and written procedures, when available, for the analytical techniques or methods used. 7)W hether the samples were taken by automatic sampler, rising -stage sampler, or manually (grab sample) 8)T he NTU of each sample, the results of the analyses, including the bench sheets, instrument readouts, computer disks or tapes, etc., used to determine the results 9)Loc ation wh ere each sample was taken (s tation number and left or right offset ) 10) I dentification of whether a sample is a r eceiving-w ater sample o r an outfall sample 11) Pr oject number and c ounty 12) A clear note if a sample exceeds 1000 NTUs by writing “exceeds 1000 NTUs” prominently upon the re port c.Report Re quirements with No Qualifying Rainfall Even ts In the ev ent a qualifying r ainfall event does not produce a discharge to sample, or sampling is “impossible”, as defined in the GAR1000002 Permit, a written justification must be included in the report as required at Part IV.D.4.a.(6) of the GAR100002 Permit. d.Sampling Results Provide sampling r esults to the Project Engineer within 48 hours of the samp les b eing analyzed. This not ification may be ve rbal or writ ten. This no tification does not replace the re quirement to submi t the formal summary to the Eng ineer with in 7 working days of the samp les b eing collected . The Engineer will ensure submission of the sampling report to GAEPD by the 15th of the month following the samplin g r esults as per the GAR100002 Permit. The WECS will be held accountable for delayed delivery to the D epartment which results in late submissions to GAEPD resulting in enforcement actions. 165 165 165 165 165 165 165 165 165 165

3.R ainfall Data Reports: Record the measurement of rainfall within disturbed areas that have not met final stabilization once each -hour period, except for non- working Saturdays, non- working Sundays and non- working Federal Holida ys unti l a Notice of Termination is submitted. Project rain gauges and those used to trigger the automati c s amplers are to be emptied after every rainfall event. This will prevent a cumulative effect and prev ent auto matic samplers from taking samples even though the rainfall event is not a qualifying event. The daily rainfall data supplied by the WECS to the Engineer will be the official rainfall data for the project for compliance with the permit. 167.3.06 Quality Acceptance General Provisions 101 th rough 150. 167.3.07 Contracto r Warranty and Maintenance General Prov isions 101 t hroug h 150.

167.4Measureme nt

Water Quality Inspections in ac cordance with the inspection and re ports sub-sections will be me asured for pa yment by the month up to the time the Contract Time exp ires. Re quired inspections and re ports after Con tract Time h as expired will no t be me asured for pa yment unless a time extension is granted. 167.5Payment

Payment for Water Quality Inspections and W ater Quality Sampling will be made as follows : Water Quality Inspections will be pa id at the Con tract Pr ice p er month. This is fu ll compensati on for pe rformin g the requiremen ts of the inspection section of the NPDES Permit and t his Specification, any and all nec essary in cidentals, and prov iding results of inspections to the Engineer, withi n the time frame re quired by the NPDES Infrastruc ture Permit, and th is Specif ication. Water Quality M onitoring and S ampling per e ach qualifying rainfall sampling event is fu ll compensati on for meeting the requiremen ts of the monit oring sections of the NPDES Permit and this Specification , obtaining samp les, analyzing samp les, any and all ne cessary incidentals, and prov iding results of t urbidity tests to the E ngineer, withi n the time frame re quired by the NPDES Infr astruc ture Permit, and this Specification . This item is b ased on the r ainfall even ts requiring samp ling as described in Part IV.D .6 of the Permit. Th e Department will no t pay for samp les ta ken and analyzed for r ainfall events that are no t qualifyin g events as compared to the d aily rainfall d ata supplied by the WECS.
