The Lexington-Fayette Urban County Government Permit Guide For Fences & Retaining Walls extends the permit requirement to fences and walls 24 inches or higher above grade, leaving fences below that height outside it. The 2018 Kentucky Residential Code separately lists fences up to seven feet tall among the work for which permits are not required.
