Permit Requirements

Exemptions: G.S. 160D-1110(a) requires permits for construction, reconstruction, alteration, repair, movement, removal, or demolition of any building or structure, but subsection (c) exempts statewide any such work costing $40,000 or less in a single-family residence, farm building, or commercial building when performed per the current NC State Building Code — unless it involves load-bearing structures (window, door, and exterior siding replacement remain exempt), plumbing additions/design changes, HVAC or electrical additions/design changes, non-code materials, addition of roofing (replacement excluded), or work covered by the NC Fire Code. North Carolina deleted IRC R105.2 from its Residential Code, so these statutory exemptions (plus the code's scope limits, e.g., accessory buildings 12 ft or less in any dimension) are the statewide rule. Local governments administer permitting and local ordinances may add requirements.
Exemptions: New deck construction requires a permit because G.S. 160D-1110(c)(1) excludes the addition, repair, or replacement of load-bearing structures from the statewide exemption; however, the statute expressly requires no permit for replacement of the pickets, railings, stair treads, and decking of porches and exterior decks costing $40,000 or less when performed per the current NC State Building Code. So like-for-like deck surface and railing replacement up to $40,000 is exempt statewide, while structural deck work of any cost needs a permit. Local jurisdictions administer permits and may apply additional local ordinances.
Exemptions: G.S. 160D-1110(a)(4) requires permits for installation, extension, alteration, or general repair of electrical wiring, devices, appliances, or equipment, except that in one- or two-family dwellings no permit is needed for repair or replacement of electrical lighting fixtures or devices such as receptacles and switches with a fixture/device of the same voltage and the same or less amperage, performed by an electrical contractor licensed under G.S. 87-43 to the current NC Electrical Code. The $40,000 general exemption in subsection (c) does not cover electrical additions or design changes other than like-kind replacement of devices and fixtures. Local jurisdictions issue and administer the permits.
Exemptions: G.S. 160D-1110(c) exempts from permits any construction, repair, or replacement costing $40,000 or less performed in accordance with the current NC State Building Code in a single-family residence, and its roofing carve-out at (c)(5) applies only to the addition of roofing, excluding replacement — so like-for-like roof replacement costing $40,000 or less requires no permit statewide. Adding new roof area (or replacement jobs over $40,000) requires a permit. Local jurisdictions administer enforcement, so confirm locally.
Exemptions: Under the North Carolina Residential Code, Section R101.2.1 provides that only accessory buildings with any dimension greater than 12 feet (3658 mm) must meet the provisions of the code, so a one-story accessory building no larger than 12 ft x 12 ft (144 sq ft footprint) falls outside the residential code and needs no state building-code permit; North Carolina deleted IRC Section R105 (permits), so permitting is governed by the NC Administrative Code and Policies and G.S. 160D-1110. Accessory buildings up to 400 sq ft may also be built without a masonry/concrete foundation (with anchoring conditions, except in coastal/ocean hazard areas), but buildings with any dimension over 12 feet require a permit. Local zoning setback and location rules still apply.
Exemptions: G.S. 160D-1110(a)(2) requires no permit for connecting a replacement water heater in a one- or two-family dwelling if the work is performed by a plumbing contractor licensed under G.S. 87-21 who performs a leak test on gas piping, and the energy use rate/thermal input is not greater than the unit replaced with no change in fuel, energy source, location, capacity, or routing/sizing of venting and piping, installed per the current NC State Building Code. G.S. 160D-1110(a)(4) similarly exempts reconnecting an existing branch circuit to a replacement electric water heater of the same or less capacity and electrical rating in the same location when done by a licensed electrical contractor. Replacements not meeting every condition (or DIY installs) require a permit; local jurisdictions administer this.
