IMC — International Mechanical CodeNOT DIRECTLY ADOPTED — NEBRASKA'S STATE BUILDING CODE DOES NOT NAME THE INTERNATIONAL MECHANICAL CODE, AND THE WORDS "MECHANICAL" AND "INTERNATIONAL MECHANICAL CODE" DO NOT APPEAR ANYWHERE IN Neb. Rev. Stat. s. 71-6403. BUT THE IMC IS NEVERTHELESS OPERATIVE IN NEBRASKA BY REFERENCE, AND THE PROOF IS IN WHAT THE LEGISLATURE CHOSE **NOT** TO EXCEPT. s. 71-6403(1) adopts four codes and carves exceptions out of three of them: "(a) The International Building Code (IBC), 2018 edition, EXCEPT SECTION 101.4.3 AND CHAPTER 29 (with specified exceptions for ss. 305.2.3 and 310.4.1); (b) The International Residential Code (IRC), 2018 edition, EXCEPT SECTION R313 AND CHAPTERS 25 THROUGH 33; (c) The International Existing Building Code, 2018 edition, EXCEPT SECTION 809; and (d) The Uniform Plumbing Code, 2018 edition, designated by the American National Standards Institute." s. 71-6403(2): those codes "shall constitute the state building code except as amended pursuant to the Building Construction Act." *** IN THE 2018 IBC, s. 101.4.3 IS "PLUMBING" (the referenced-code section making the IPC applicable) AND CHAPTER 29 IS "PLUMBING SYSTEMS"; s. 101.4.2 IS "MECHANICAL" AND MAKES THE INTERNATIONAL MECHANICAL CODE APPLICABLE.
