An individual, firm, or corporation who meets one or both of the following criteria: (a) Fabricates or processes a material not on the site of work per 29 CFR 5.2(l)(3). (b) Delivers material directly to the project. In both cases, the material shall be intended for permanent incorporation into the worksite.
