Do you need a permit?
San Jose requires a permit for a fence.
A building permit is not required to construct a fence unless the project exceeds the maximum heights set forth in the municipal code. On the City's Fences & Retaining Walls page the maximum allowable fence height without a permit is 3 feet in a front yard, 7 feet in a side yard and 7 feet in a rear yard; on corner lots it is 3 feet for a front yard along the street, 3 feet for a side yard along the street, and 7 feet for rear and side yards not along the street, where rear and side fence heights must also be low enough to provide sightlines to the street from the driveway. Different height restrictions may apply on irregular-shaped lots and on lots in planned development (PD) zones. San José Municipal Code Section 24.02.120 separately exempts fences other than swimming pool barriers that are not over seven feet high from the building permit.
