Do you need a permit?
San Jose requires a permit for a retaining wall.
The City's Fences & Retaining Walls page says no building permit is needed for a retaining wall unless it goes beyond the maximum heights set in the municipal code, and it treats a wall of 2 feet or less above existing grade as staying within them. San José Municipal Code Section 24.02.120 sets the exemption at 4 feet, sized from the footing base to the wall's highest point, and withdraws it where the wall carries a surcharge or holds back Class I, II or III-A liquid.
