Do you need a permit?
New York City requires a permit for a retaining wall.
Retaining walls stay outside the permit requirement in New York City below 4 feet (1219 mm), sized from the top of the footing up to the wall's highest point. The exemption holds only where nothing above adds load behind the wall and where the wall is not holding back Class I, II or III-A liquids, which section 307.2 of the New York City Building Code defines.
