Fence permit checklist — Miami, Florida

Assembled from Miami’s own published permit rules. Every line below is quoted from a city document and linked to it. Nothing here is generated, estimated, or inferred from another jurisdiction.

Do you need a permit?

Miami requires a permit for a fence.

When a permit is not required

Fla. Stat. 553.79(1)(g), effective July 1, 2026 under Chapter 2026-63, Laws of Florida, obliges Miami to exempt single-family residential work worth under $7,500 from the building permit requirement once the owner or contractor files a written request backed by the contract or similar documentation. Structural work is excluded at any value, and so is any property wholly or partly inside a Florida Building Code flood hazard area. Whether the city treats a fence as structural is not answered by the statute, and Miami has published nothing on the point; a fence over six feet already goes to structural review here, which makes the question worth raising with the Building Department before skipping a permit.
