Do you need a permit?
Orlando requires a permit for a fence.
A fence permit is NOT required if ALL of the following apply: the fence is located on a one or two-family residential property; the fence is six feet or less in height where allowed, with all heights measured from the established normal building site grade; the fence is not located within a Historic Preservation district, which must comply with Chapter 62; the fence materials are one of wood, plastic/vinyl, chain-link, aluminum, wrought-iron or plant-material; and the fence complies with Special Plan (SP) overlay and Planned Development (PD) districts and Orlando Code Chapter 58 Part 5B(5). A fence that does not need a permit must still comply with City Code, and fences within a Homeowner's Association still require HOA approval. Separately, the $7,500 residential permit exemption added by Florida Statutes Section 553.79(1)(g) effective July 1, 2026 does not extend to fences in Orlando. The city groups pool barriers and fences under structural work, a category ineligible for that exemption at any project value, so a fence that needs a permit under the conditions above still needs one.
