Do you need a permit?

Eugene requires a permit for a retaining wall.

When a permit is not required

A retaining wall needs no building permit at 4 feet or under, sizing that height from the footing base up to the wall's highest point, so long as nothing steeper than a 3:1 ascending slope pushes against it and it carries no nonsoil surcharge. The Building Official may also waive the permit where a wall sits somewhere its failure would put neither people nor property at risk. Both routes to exemption close if the wall crosses subsurface disposal systems or public pipes, or reaches into a public utility easement, flood plain, setback or stormwater treatment system.
