Do you need a permit?
Hialeah requires a permit for general building work.
Effective July 1, 2026, Florida Statutes Section 553.79(1)(g), enacted as part of Chapter 2026-63, Laws of Florida (CS/CS/HB 803, 2026 Regular Session), requires Florida cities that issue permits to exempt work worth under $7,500 done on a single-family dwelling by the owner or the owner's contractor. Hialeah has published guidance and calls this a limited exemption, cautioning that most work still needs a permit whatever it costs. The Building Division confines it to cosmetic and maintenance work that leaves regulated systems and the structure alone, and offers as examples interior painting, floor replacement with no structural change, cabinet refacing or like-for-like cabinet replacement with no plumbing or electrical change, minor non-structural drywall patching, interior trim and baseboard repair, landscaping subject to zoning rules, and minor roof repair such as replacing shingles or fixing a small leak. A permit is always required, whatever the cost, for electrical, plumbing, mechanical or HVAC, gas, and any structural work reaching walls, beams, roofs or openings. To claim the exemption the owner or contractor submits a written exemption request together with a contract or other paperwork establishing the scope and showing the total is below $7,500; filings go through the city Tyler Citizen Self Service portal and are reviewed by staff. Property inside a flood hazard area is ineligible, and the city hosts a flood zone GIS map for checking. Alterations that need zoning review and approval do not qualify. A project may not be split into smaller parts to get under $7,500. The city flyer limits the exemption to single-family residential property, while the city web page also names two-family duplexes and true townhouses. Hialeah has not published a review deadline or a fee for the request.
