N.J.A.C. 5:23-2.7 treats the repair or replacement of any part of a deck, porch or stoop that does not provide structural support for a roof or any portion of a building as ordinary maintenance, provided the materials used are identical or closely similar to the existing materials and are placed in the same location; that work needs no permit and no notice. N.J.A.C. 5:23-2.17A treats the construction or total replacement of a porch or stoop that does not provide structural support for a roof or any portion of a building as minor work, which requires a permit but may begin once notice is given to the construction official.
