When a permit is not required

Cape Coral guidance on HB 803 rules out structural components from the $7,500 residential exemption in Florida Statutes Section 553.79(1)(g), effective July 1, 2026, but the city has not published a list saying whether deck framing falls in that category. Two other limits bite first for most Cape Coral homeowners. More than 60 percent of the city sits inside a FEMA mapped Special Flood Hazard Area by the city's own count, and any parcel touching that mapping is ineligible. Even for a qualifying deck, an exemption request has to be filed through the city online portal and approved before construction starts.
