Cape Coral requires a permit for a retaining wall.
Two pieces of Chapter 2026-63, Laws of Florida (CS/CS/HB 803, 2026 Regular Session) touch retaining walls as of July 1, 2026. Florida Statutes Section 553.79(1)(i) requires a local government to let a retaining wall crossing several lots be permitted as one project at single-family, two-family and townhouse properties, instead of forcing a separate permit for each lot. Section 553.79(1)(g) is the separate exemption for work under $7,500, which Cape Coral administers as a reviewed request; its guidance excludes structural components and the city has issued no reading on retaining walls, and by the city own count more than 60 percent of Cape Coral falls inside a FEMA mapped Special Flood Hazard Area where the exemption is unavailable. Cape Coral has published nothing describing how it processes a single-project retaining wall filing.
