1608 UNACCEPTABLE MATERIALS The Department considers Materials that do not meet the Contract requirements before being incorporated into the Work as unacceptable. The Engineer will reject unacceptable Material. The Contractor shall remove unacceptable Material from the Project, unless otherwise directed by the Engineer as allowed by 1603, “Materials: Specifications, Samples, Tests, and Acceptance.” The Contractor may use Material that the Department determined was unacceptable if the Contractor brings the Material into compliance.
