When a permit is not required

OC Development Services adopts the California Building and Residential Codes for unincorporated county territory and does not publish a standalone exempt-work handout on its building and safety pages, so the State exemption list in CBC/CRC Section 105.2 governs by default: detached accessory structures to 120 square feet, fences to 7 feet, retaining walls to 4 feet where they do not support a surcharge, and decks up to 200 square feet that stay within 30 inches of grade and are not attached to a dwelling. The County does publish structural and zoning guidance for walls, noting that a wall treated as non-retaining should not exceed 6 feet in height, and that zoning caps wall and fence height at 3.5 feet within a required front setback and 6 feet within rear or side setbacks, which frequently binds before the building code exemption does. Because the exemption thresholds are not restated in a County handout, confirm your specific case with OC Development Services before relying on them.
