Do you need a permit?
Orange County requires a permit for a retaining wall.
Orange County has no exempt-work handout, so the State CBC/CRC 105.2 rule controls in unincorporated territory: the building-permit exemption stops at 4 feet of wall height — counted from footing bottom to wall top — and disappears entirely if the wall carries a surcharge. Backfill that slopes, a driveway, a pool, or a footing behind the wall each count as a surcharge, no matter how short the wall is. OC Development Services lists retaining walls among the residential improvements that require a permit, and in the unincorporated canyon and hillside areas a wall that moves earth also triggers a separate grading permit.
