Do you need a permit?
Orange County does not require a permit for a fence.
Because OC Development Services does not publish a County exempt-work handout, the State CBC/CRC 105.2 threshold of 7 feet applies for the building permit exemption in unincorporated territory. The County's own permit FAQ notes that a wall treated as non-retaining for structural purposes should not exceed 6 feet in height, and separately that zoning limits fence and wall height to 3.5 feet within any required front setback and 6 feet within any rear or side setback. In practice the zoning limits bind before the building code exemption does, so a fence can be exempt from a building permit and still require a zoning variance. Any fence acting as a pool or spa barrier is regulated under the pool enclosure rules.
